Acceptance of Terms
By using LobFile, you agree to these Terms of Service and our Privacy Policy. If you do not agree with these terms, do not use LobFile. LobFile may update these Terms from time to time. We will post the updated version with a "Last Revised" date. Your continued use of LobFile after changes are posted constitutes your acceptance of those changes.
Eligibility
You must be at least 18 years old to use LobFile. By using the service, you represent and warrant that you meet this requirement.
Account Restrictions
Each person, organization, or entity is permitted to hold only one account on LobFile. Creating or controlling multiple accounts, whether directly or through others, to bypass restrictions or for any other purpose is strictly prohibited. LobFile reserves the right to terminate any accounts found to be in violation of this policy and delete any associated data.
Key Rules & Prohibitions
- Do not impersonate someone else.
- Do not upload any file that is a virus or malware.
- Do not upload data taken from another person's device, account, or network without their authorization, and do not use LobFile as any part of the infrastructure for malicious software. See the Stolen Data, Malware & Unauthorized Access section below.
- Do not upload copyrighted files without rights or authorization.
- Do not upload any file that is illegal in the United States or your country of origin.
- Do not upload child sexual abuse material (CSAM). LobFile does not proactively scan the contents of uploaded files, but will act on any reports or knowledge obtained through normal operation. Any CSAM identified will be reported to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by 18 U.S.C. § 2258A.
- Do not upload non-consensual intimate imagery (NCII).
- Do not upload terrorism or violent extremist content, or material that promotes or facilitates acts of mass violence.
- Do not upload content that facilitates human trafficking.
- Violations may result in immediate account termination, deletion of your files, reporting to authorities, or other legal actions.
To report suspected violations of the above prohibited content categories, contact support@lobfile.com with details such as a link or file identifier.
Stolen Data, Malware & Unauthorized Access
LobFile may not be used to store, transmit, stage, or distribute data obtained from a person, device, account, network, or system without the authorization of its owner, and may not be used as any part of the infrastructure for malicious software. This prohibition applies to the data that malicious software collects, not only to the software itself. Uploading such data is a violation of these Terms whether the upload is performed by you, by a person acting on your behalf, by an API key issued to your account, or automatically by software you wrote, distributed, operated, or configured.
Without limiting the above, the following are prohibited:
- Credentials and authentication material taken without authorization, including usernames and passwords, password manager exports or vaults, browser saved-password stores, session cookies, authentication tokens, API keys, and multi-factor authentication secrets or backup codes.
- Cryptocurrency wallet material taken without authorization, including wallet files, wallet extension data, keystores, seed or recovery phrases, and private keys.
- Copies of another person's files, directories, drives, or device contents captured without their authorization, including browser profiles, autofill and form-fill data, chat and email archives, documents, photographs, keystroke logs, clipboard captures, and screenshots or screen recordings of their device.
- Bulk personal data obtained from a breach, scrape, or unauthorized access, including database dumps, credential combination lists ("combolists"), stealer logs, and compiled dossiers on individuals.
- Payment and identity data obtained without authorization, including payment card numbers, bank account details, government identification documents, and Social Security or national identity numbers.
- Using LobFile as an exfiltration endpoint, drop site, dead drop, staging host, command and control channel, update or payload delivery host, or hosting for phishing pages, phishing kits, or credential harvesting pages.
- Uploading or distributing information stealers, remote access trojans, keyloggers, spyware, ransomware, botnet clients, or the builders, loaders, droppers, crypters, packers, and obfuscators used to produce or conceal them.
- Uploading or distributing tooling whose purpose is to gain, sell, or trade unauthorized access to accounts, devices, or systems, including checkers, brute-force and credential stuffing tools, and access broker listings.
This section restricts unauthorized data, not security work. Uploading files you own, files you have written permission to possess, or samples handled in the course of authorized security research, incident response, malware analysis, or an authorized penetration test is not a violation of this section, provided the material is not distributed for use against others and the upload complies with the rest of these Terms, including the prohibition on uploading viruses and malware.
LobFile LLC may determine that an account has violated this section based on its reasonable judgment, including from file names, file contents, upload patterns, reports from third parties, and information provided by law enforcement. LobFile is not required to prove a violation to any evidentiary standard, to obtain your response before acting, or to disclose the basis for its determination.
Violations of this section may result in immediate termination of your account and any related accounts, deletion or disabling of your files without notice, forfeiture of any subscription fees paid, a permanent bar on future use of LobFile, notification of affected parties, and referral to law enforcement. Where LobFile has reason to believe an account has been used for the activity described in this section, LobFile LLC may preserve account records, uploaded content, and access logs for use by law enforcement, and that preservation supersedes the deletion timelines described elsewhere in these Terms and in our Privacy Policy.
To report an account or file that violates this section, contact support@lobfile.com with a link or file identifier. If the report concerns your own data, tell us what was taken so we can act on it.
Third-Party Integrations
LobFile welcomes developers and businesses building applications and services on top of the LobFile platform. If your application, service, or tool integrates with LobFile (via API, embed, or any other means), you must clearly disclose to your end users that LobFile is used for file storage and hosting. This disclosure must include a reference to or a link to LobFile's Privacy Policy so that end users are aware of what data LobFile collects and how it is handled.
As the LobFile account holder, you are responsible for ensuring this disclosure is made to any users who interact with LobFile through your integration. Failure to comply with this requirement may result in suspension or termination of your account.
Intellectual Property & Copyright
You retain ownership of your content. However, by uploading files, you grant LobFile LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, distribute, and display your content as necessary to operate and provide the service. This includes making your files available to others at your direction (for example, when you share a link).
You are solely responsible for the content you upload. LobFile LLC does not pre-screen files and has no obligation to monitor user content, though it may do so, and is not responsible for user content. If you believe any content on LobFile infringes your rights, please submit a DMCA notice to dmca@lobfile.com following our DMCA Policy.
Indemnification
You agree to indemnify and hold harmless LobFile LLC, its affiliates, officers, directors, and employees from any claims, damages, liabilities, or expenses (including attorneys' fees) arising from your use of the service or your violation of these Terms.
Dispute Resolution & Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Washington State, and you waive any right to a class action or jury trial.
Service Modifications & Termination
LobFile LLC may modify, suspend, or terminate the service (or any part) at any time without prior notice. Files may be removed at our discretion. We do not guarantee permanent storage or availability.
LobFile LLC may suspend or terminate your account and delete or disable your files at any time, with or without notice, where we determine in our reasonable judgment that your account has violated these Terms. We may also refuse service to anyone and bar a terminated account holder from creating a new account. Termination for a violation of these Terms does not entitle you to a refund.
Upon account termination, your data will be handled as described in the Privacy Rights section of these Terms and in our Privacy Policy, except where LobFile LLC is required to retain data to comply with applicable law, valid legal process, or law enforcement obligations.
Refund Policy
Paid subscriptions are eligible for a prorated refund of the remaining billing cycle upon request. No refund will be issued if your account was terminated due to a violation of these Terms of Service. Fees are non-refundable except as described above or as required by applicable law.
Security & Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials. LobFile LLC will not be liable for unauthorized access caused by your failure to protect your login information.
Disclaimer of Warranties
The service is provided on an "as is" and "as available" basis. LobFile LLC makes no warranties, expressed or implied, regarding reliability, availability, or security of the service.
Risk and Limitation of Liability
Use LobFile at your own risk. In no event shall LobFile LLC or its owners be liable for any direct, indirect, incidental, or consequential damages arising from use of the service.
LobFile is a file hosting and sharing service and does not undertake to inspect, screen, or classify uploaded content. Any review LobFile does perform, whether automated or manual, is carried out for the enforcement of these Terms and creates no duty to detect, review, or remove any particular content. Users who choose to upload sensitive information - including personal records, financial documents, identity documents, medical records, or other private data - do so entirely at their own risk. LobFile LLC is not liable for any unauthorized access, disclosure, or misuse of content that users upload or share through the service.
In no event shall LobFile LLC's total aggregate liability to you exceed the amounts paid by you to LobFile in the twelve (12) months preceding the claim giving rise to liability. For users on a free plan, this cap is zero dollars ($0.00).
Your Data & Inactivity
Files you upload may be accessible if links are shared. We cannot guarantee absolute confidentiality. Accounts inactive for 12+ months may be deleted along with all data. LobFile will send a warning email to your registered address before taking this action; your account will not be deleted if the warning email cannot be delivered.
Law Enforcement & Data Preservation
LobFile LLC will comply with valid legal process, including subpoenas, court orders, and law enforcement data preservation requests under 18 U.S.C. § 2703(f). Where required by law, LobFile will preserve account data and records in response to such requests.
Legal preservation obligations supersede LobFile's standard data retention and deletion schedules. LobFile will not notify the account holder of the existence of a legal request, preservation order, or related inquiry unless legally permitted and required to do so.
Privacy Rights (GDPR & CCPA)
LobFile LLC is registered in Washington State, USA. LobFile does not sell, rent, or share your personal data with third parties for advertising or marketing purposes. Data processing tools used in the operation of this service include Sentry (error tracking), Google reCAPTCHA (anti-abuse), and Stripe (payment processing). No advertising or behavioral tracking tools are used.
You may delete your account instantly via the self-service page at lobfile.com/dashboard/delete-account, which is automated and takes effect immediately without contacting support. Alternatively, you may request deletion by contacting support@lobfile.com. Upon deletion, your account data - including files, login credentials, email, and database logs pertaining to the account - is made immediately unavailable and deleted from live infrastructure. Deleted data may persist in encrypted backups for up to one year, after which it is permanently purged, except where retention is required by law.
For users in the European Economic Area (EEA): You have rights under the General Data Protection Regulation (GDPR), including the right to access, rectify, erase, restrict, or port your personal data, and the right to object to certain processing. Server logs (including IP addresses and user agent strings) are generally retained for no more than six weeks. To exercise your rights, contact us at support@lobfile.com.
For California residents: LobFile does not sell personal information as defined under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Reservation of Rights
LobFile LLC reserves all rights not expressly granted to you under these Terms.
Copyright Complaints (DMCA)
LobFile LLC respects the intellectual property rights of others. If you believe that content on LobFile infringes your copyright, please follow our DMCA Policy for instructions on submitting a notice.
