LobFile respects the intellectual property rights of others and expects its users to do the same. This policy outlines the process for submitting DMCA takedown notices and counter-notices in compliance with the Digital Millennium Copyright Act ("DMCA").
Notification of Claimed Infringement:
If you believe that your copyrighted work has been used on LobFile in a way that constitutes copyright infringement, you must send us a written notice that includes all of the following:
- A physical or electronic signature of the copyright owner or an agent authorized to act on their behalf.
- Identification of the copyrighted work(s) claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the material on LobFile that is claimed to be infringing and information reasonably sufficient to locate the material.
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
Send your DMCA notice to: dmca@lobfile.com
Counter-Notification:
If you believe your material was removed due to a mistake or misidentification, you may file a counter-notification. Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location on LobFile before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement consenting to the jurisdiction of the federal court in your district and agreeing to accept service of process from the party that filed the DMCA notice.
Upon receiving a valid counter-notification, LobFile will forward the matter to the original complaining party. They must then seek a court order to reinstate the material if they wish to do so.
Repeat Infringers:
LobFile reserves the right to terminate accounts of users who are found to be repeat infringers. We don’t mess around when it comes to protecting intellectual property.
